TERMS & CONDITIONS
INTRODUCTION
1. ‘We’ refers to School of Surf, its employees, and its contractors and ‘you’ and ‘your’ refer to whomever is utilising our services.
2. This agreement outlines the terms and conditions both for the use of this website and for any services provided to you by our company.
3. In addition to these terms and conditions, you must also comply with our Privacy Policy.
ACCEPTANCE OF THESE TERMS AND CONDITIONS
1. By navigating our webpage and utilising our services, you have signified acceptance of these terms and conditions. You will be prompted should you be required to accept any terms not stated in these Terms and Conditions.
BOOKING A LESSON
1. We are unable to make any guarantee as to whether or not we will be able to provide an instructor for your particular circumstance. Bookings are subject to availability as well as the weather. We will, of course, endeavour to do so.
WINDSURFING LESSONS
1. All of our instructors go through working with children checks as legally required and our recruitment process is designed to filter out suspect individuals. Therefore, we accept no liability for any grievances that occur in a windsurfing session.
2. If you wish to cancel a windsurfing lesson, you must notify us via email or telephone with at least 24 hours notice, otherwise you will be charged a 65% late cancellation fee.
3. A breakages deposit may be required to be payable before the commencement of booked lessons.
4. An indemnity form will be required to be completed before the commencement of booked lessons.
5. All adults are required to be able to swim 50m prior to acceptance of the booking.
6. All children are required to be able to swim 25m prior to acceptance of the booking.
7. We cannot guarantee competency, due to different learning abilities, and/or predispositions.
WINDSURFING EQUIPMENT
1. All windsurfing equipment necessary for the particular lesson will be provided by School of Surf.
2. Students are required to provide their own towel, food (where full day sessions are booked), and sunscreen as well as taking all other precautionary methods to protect themselves from the sun.
3. Equipment is used at the student's own risk, and any and all breakages will be required to be settled by the responsible person.
CUSTOMERS WARRANTIES, LIABILITIES AND UNDERTAKINGS
1. You agree to indemnify and keep indemnified and hold us harmless from and against any claim brought against us by a third party resulting from the provision of Services by us to you.
SCHOOL OF SURF WARRANTIES, LIABILITIES AND UNDERTAKINGS
1. We have every measure in place to ensure the security of your information, however, the internet is never completely secure. Consequently, we accept no liability for any loss, damage, cost, or expense incurred through the use of our website.
2. School of Surf accepts no liability for injury to yourself or any third party sustained during lessons booked.
SEVERABILITY
1. If any clause of these terms and conditions is held to be legally invalid or unenforceable, the invalid or unenforceable wording shall be deemed to be omitted.
CHANGES TO TERMS
1. We may change the terms and conditions of this agreement at any time. Current terms and conditions will always be displayed on our website. It is your responsibility to regularly check the terms and conditions.
